Government lawyers on Thursday, March 24 asked Judge Thomas Zilly to remove certain children’s names in a lawsuit that seeks to mandate court-appointed attorneys for indigent children who have entered the United States in an illegal manner.
However, lawyers for the New York City based non-profit organization American Civil Liberties Union and immigration rights groups claimed that any child sent to an immigration court has a constitutional right to a fair trial, which could only occur if he/she would be provided with his/her own lawyer. The ACLU also asked Zilly to expand the case to cover children across the country.
Zilly stated after a four-hour hearing that he would take both panels’ propositions under advisement and make a ruling at a later date.

Immigration reform was a major topic at a town hall meeting in Las Vegas, Nevada on Thursday, February 18 as both Democratic candidates for president – former Secretary of State Hillary Clinton and Vermont Senator Bernie Sanders – sought to convince Nevada’s Hispanic population that their policies and plans would be the best match to address such a controversial issue.

A statement coming from United States Department of Homeland Security Secretary Jeh Johnson was released on Monday, January 4. In it, Johnson stated that Immigration and Customs Enforcement (ICE) has started “nationwide enforcement operations to take into custody and return at a greater rate adults who entered [the United States] illegally with children.”
Johnson added that the deportation efforts would be focused on “adults and their children who were apprehended after May 1, 2014 crossing the southern border illegally; have been issued final orders of removal by an immigration court; and have exhausted appropriate legal remedies, and have no outstanding appeal or claim for asylum or other humanitarian relief under our laws.”

Austin, Texas-based nonprofit organization Workers Defense Project has held a demonstration that called for immigration reform by conducting a 35-mile protest march from the T. Don Hutto Residential Center in Williamson County, an area which houses asylum-seeking immigrants, to the Governor’s Mansion in downtown Austin.

The marchers were attempting to call Governor Abbott’s attention to what they believe to be misguided opinions and political errors on his part in relation to immigration reform.
Aside from showing their support for the DAPA initiative, the people in the march also supported the Deferred Action for Childhood Arrivals (DACA), which was started by United States President Barack Obama in 2012 and made it possible for undocumented immigrant children to obtain their first identification cards, get legal work permits, and avoid deportation.

An appeals court dealt a major blow to President Barack Obama’s executive action to delay deportation of more than 4 million undocumented immigrants a year after it was issued, effectively upholding a preliminary injunction which was filed by 25 states and was granted in February to block implementation of the measure.
In its decision, released last Tuesday, November 10, the Fifth Circuit Court of Appeals, led by Circuit Judge Jerry Smith, held that the President’s initiative, called the Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA), “affects the states’ ‘quasi-sovereign’ interests by imposing substantial pressure on them to change their laws, which provide for issuing drivers’ licenses to some aliens and subsidizing those licenses.”

Although Texas is one of the most vocal among the states objecting to President Obama’s executive measure to delay the deportation of some undocumented immigrants in the United States, not all of the state’s leaders agree with former state attorney general, now Governor, Greg Abbott’s lawsuit. Austin, Texas’s initiative – the Asian American Quality of Life Initiative – which copies similar efforts for the city’s African-Americans and Hispanics, is still in its preliminary stages, but city officials and non-profit organizations have been saying that some of the challenges facing members of Asian communities are in the process of being addressed.
According to city demographer Ryan Robinson, Asians who immigrated to Austin increased to 6.5% of the population from 3.3% of the population between the years 1990 and 2012. Robinson noted that the number of Asians living in Austin may exceed the African-American population in the years to come.
Asian American Cultural Resource Center executive director Esther Chung Martin said the Asian community in Austin, comprised of individuals from two dozen nations from Mongolia to Pakistan including Filipinos, Taiwanese, Thais, Afghans, and refugees from Myanmar, Bhutan, and Nepal, is “a huge spectrum of languages, religions, and cultures.”

The government of Mexico recently warned the state of Texas that it was jeopardizing its currently friendly relationships with the country by refusing to issue birth certificates to children born to undocumented immigrants in the state, even though they held consular identification cards that were issued by the Mexican Consulate.
Mexican officials pointed out that it is widely accepted for “friendly nations” to accept various forms of identification, such as foreign passports, in order to issue birth certificates to children born of immigrants in the United States. The brief filed by the Mexican government was in response to a lawsuit filed on behalf of six different children who were born in the U.S. to undocumented parents from Mexico, Honduras, and Guatemala, and who were not issued a birth certificate by the state of Texas.
The Mexican government has also asked Texas to articulate which specific forms of identification it requires in order for birth certificates to be issued to the children of non-U.S. citizens.
