    U.S. Deportation Facts and Statistics

Deportation Lawyer in Austin Image 2We believe that it is important for our clients to be informed about the facts and statistics surrounding U.S. deportation. According to the United States Federal Government, deportation is legally defined as the “formal removal of a foreign national from the U.S. for violating an immigration law.” The government’s grounds to deport include engaging in criminal acts, violating a visa, or posing a threat to public safety. Individuals may go through the deportation or removal process in front of a judge. If someone enters the U.S. without any travel documents or with documents that have been forged, they may be subjected to expedited removal wherein the individual does not receive a court hearing.

If you have not yet completed the removal process, you may instead choose a voluntary departure and leave the United States on your own. A voluntary departure may be a beneficial option as you can pursue admission into the States in the future. However, by choosing this option, a person cannot appeal their case. If they fail to leave the country within the time frame provided by the government, they will be fined and will have a “10-year bar to several forms of relief from deportation.”

Eligible undocumented immigrants going through the removal process may instead go through the adjustment of status process and apply for a Green Card in order to become a lawful permanent resident. The U.S. government recommends that those facing deportation seek legal advice if they wish to make an appeal to their deportation ruling.

The Center for American Progress reported that there are 43.3 million foreign-born people living in the United States. This includes 20.7 million naturalized citizens and 22.6 million noncitizens. In 2015, 26.9% of the foreign-born population were from Mexico, 2.7 million immigrants were from China, 2.4 million were from India, 2 million were from the Philippines, 1.4 million were from El Salvador, 1.3 were from Vietnam, 1.2 were from Cuba, 1.1 million were from the Dominican Republic, and 1.1 million were from South Korea. The Center reported that there has been a “drop in Mexican immigrants” and more Mexicans are beginning to return home than are arriving in the U.S.

In 2015, 51.4% of the immigrant population was female. The Center acknowledged that “in 2015, 50.7% of immigrant heads of household owned their own homes, compared with 65.2% of U.S.-born heads of household.” Less than 1 in 5 immigrants live in poverty, and compared to American-born children, immigrants are said to be more likely to attend college and become homeowners. The Cato Institute’s 2017 study found that the incarceration rate for authorized and unauthorized immigrants in 2014 was “considerably lower” than that of the U.S.-born population. In 2016, immigrants added an estimated $2 trillion to the U.S. GDP. Additional findings reported that “More than 40% of Fortune 500 companies were founded by immigrants and their children” in 2010. In 2014, 15% of the unauthorized population lived in Texas. The Center concluded that “deportations and detentions break families apart, causing emotional distress for children, forcing some into foster care, and creating single-parent households that struggle financially.”

NPR recently reported that 9 out of 10 deportations occur for immigrants from the same economically-challenged countries, which are Mexico, Guatemala, El Salvador, and Honduras. In the last year, the number of deportees from other countries increased by 24%. He reported that “deportations to Brazil and China jumped. Removals of Somalis nearly doubled. Deportations to Ghana and West Africa are up more than two times.” Haiti saw an increase in deportations over the last year, with 5,500 incidents in 2017 compared to 300 in 2018.
