A federal district court order from the Northern District of Illinois says it is illegal for federal authorities with Immigration and Customs Enforcement to issue a detainer on people detained within local law enforcement.
Explaining the decision, Director of the Immigration Clinic at the University of Texas School of Law Denise Gilman said: “The entire way in which ICE issues and implements its detainer program right now is likely unlawful. Because ICE isn’t going before any court, any magistrate, anybody at all to have a finding of probable cause.”
Texas Civil Rights Project community director Zenen Jaimes welcomed this development and added: “Thankfully I’m in a place where you know, we’re fighting some of these abuses that we still think happen in Travis Country and all over the state.”
